SAD NEWS

Com. Dawa Lama, Divisional Working Committee Member of RMS 'SG' Division, Siliguri and a good organizer of R-III union, is no more with us. He passed away yesterday (26-10-2013) at the age of 57.
All India RMS & MMS Employees Union, group- 'C', West Bengal Circle conveys its heartfelt condolences to his bereaved family members and friends.

Respected Sir,
                         We are very sorry to express our views with deep concern that since last few months the Administration particularly the PMG(MM) is playing a role which is not match with the culture of the State like West Bengal.

            He has a tendency for taking unilateral decision bypassing the Service Unions as well as failed to keep confidence to the family members of RMS & MMS as a whole.

            In some occasions the Dte.’s decisions are not taken into account. Safety and Security of the Staff are not taken into consideration which causes a great resentment among all cross section of Staff including DRMs/ SDS Drivers.

            Under these circumstances we are compelled to submit the memorandum for immediate settlement. In this connection it is also urges to advise the PMG(MM) for arranging an open mind discussion within the next week and request you till this time status-quo will maintain.

            Any kind of deviation or forcible imposition may hurt to the Employees of RMS & MMS. To avoid the surcharge of the situation the cordial relation which prevailing now at this moment should maintain.

MEMORANDUM

  1. Stop the irregular procedure in c/w functioning of TVP & TMP.
Note: Some TVP & TMP introduced by the Department to develop the delivery benefit to the public without obtaining any permission from the respective Railway Authority. The TVP/ TMP introduced by the Department urge either to stop or to obtain permission from the Railway Authority within seven days and maintain the norms of functioning TVP & TMP.

  1. Functioning of some transit Sections.
 Note: The report received by the organization that, some transit sections which were converted after abolition of the Sorting Sections will ply as usual as per decision of the Departmental Council. Without discussion any kind of change is not acceptable.

  1. Stop fragment introduction/ Modification of Schedule.
 Note: The staffs, who are related with the Schedules, are facing much trouble for fragment change/ modification of schedule. The proposals and discussions are not taken into account.

  1. Rate of SDS Drivers.
 Note: It is a long pending issue. The SDS Drivers are utilized in full fledged for functioning the MMS Schedules but the enhancement of Rate are not considered.

  1. Payment of DRM.
 Note: Acute shortage of Staff are the main factor for which the DRMs were engaged to pull up the all kinds of traditional works but in c/w their payment a delay tactics and reluctant attitude are followed- causes a great resentment among all cross section of employees.

  1. Reorganization in the name of MNOP.
 Note: For functioning of CRC in various divisions some unilateral decisions are taken without taking into account about the staff position of the Division. Demand for proper discussion before taking final decision.

  1. Deployment of Staff from one Division to other.
 Note: Most of all the divisions are running with acute shortage of manpower. So the redeployment of the staff from one division to other division not at all wise.

DISCUSSION WITH MEMBER (OPERATIONS)
ON MNOP AND L1, L2 RELATED ISSUES DATED 23.10.2013
On 23.10.2013, Member (Operations), Postal Services Board, Shri. Kamaleshwar Prasad, held discussion with Staff side on MNOP and L1, L2 related issues. Com. M. Krishnan, Secretary General NFPE, Com. Giriraj Singh, General Secretary, R3 (NFPE), Com. P. Suresh, General Secretary R-4 (NFPE), Com. Devender Kumar, Circle Secretary, NUR-3 (FNPO) Delhi Circle attended the meeting Com. D. Theagarajan, Secretary General, FNPO & General Secretary NUR-3 (FNPO) could not attend the meeting due to sudden illness. A joint note of NFPE & FNPO was presented to the Member (O). The following are the outcome of the meeting. Minutes will be published later.
(1)      Modifications in the norms fixed for CRCs.
Official side informed that the norms are fixed as per the scientific work study conducted by Directorate in the field units. Further Directorate has issued an order on 13.08.2013 in which it is clarified that – Establishment norms for “Sorting of Articles” has been fixed as 0.079 minute per article (i.e. 760 articles per hour). However time factor for productivity pertaining to sorting of articles would continue to be 0.063 per article (i.e; 950 articles per hour).”
Staff side demanded reduction in number of article for productivity also. Staff side want change in norms for scanning and other items mentioned in their letters submitted earlier. Finally it is decided to give copy of the work study conducted by Directorate to the staff side. Staff side shall submit concrete proposal with scientific basis with supporting facts and figures justifying their arguments. Based on the staff side proposal Directorate will re-examine the case.
(2)   Administrative jurisdiction of Speed Post Hubs (SH)
Official side reiterated that powers for deciding the administrative jurisdiction was already given to Chief PMGs. It is upto the Circle Unions to discuss the case at Circle level and settle the deserving cases. Staff side pointed out that in many Circles Chief PMGs are not ready to accept the views expressed by the Circle Unions. Finally it is decided that (1) As a first step Circle Unions should discuss the cases with Chief PMGs in formal meetings and get a reply in writing from the Circle Administration showing the reason for not accepting the demand of the Circle union and then staff side may submit a note to Directorate justifying their stand in each case with reference to the Stand taken by Chief PMGs. After that Directorate shall review each case. Discussion with CPMGs in the formal meetings and getting a reply with reasons, is a must.
(3)   L1 Status to more L2 offices
The proposal submitted by staff side will be examined. Staff Side may discuss the cases at circle level also so that Chief PMGs may submit proposal to Directorate in deserving cases. The details of the case by case examination already conducted by Directorate will be made available to the staff side.
(4)   Discontinuance of closing “NIL” bags
The proposal of the Staff side will be considered in a positive manner and detailed examination of the case will be done.
(5)   All other issues raised in the staff side note will be examined in detail by the Directorate and action will be taken.
(6)   The orders issued by the Karnataka Circle Administration implementing unilateral increase in norms in FMC from 7000 to 9000 in BG City RMS/1 and from 11000 to 13000 in BG City RMS/II in violation of Directorate orders was discussed. Member (O) agreed to issue instructions to CPMG not to violate Directorate orders.

Against:
1. The unilateral decision taken by the authority keeping the Service Unions in dark causes the resenment among the members of the RMS & MMS family.
2. Bypassing the Dte decision and Minutes of the Departmental Council the authority moving fast to implement the unilateral order.
3. The safety and Security of the Staffs are not taken into consideration.

NFPE & FNPO DECIDED TO GO ON NATIONWIDE INDEFINITE STRIKE IF THE DEMAND FOR INCLUSION OF GRAMIN DAK SEVAKS UNDER THE PURVIEW OF 7THCENTRAL PAY COMMISSION IS NOT ACCEPTED BY THE GOVERNMENT.
THE MAIN DEMANDS OF THE STRIKE WILL BE:
(1) Inclusion of Gramin Dak Sevaks under the purview of 7thCPC

(2) Regularisation of Casual, Part-time, Contingent Employees and Revision of their wages with effect from 01.01.2006 (as per 6th CPC wage revision) & Grant of DA

(3) Merger of 50% DA with pay for all employees including GDS

The above decision was taken in the Central JCA Meeting held on 19.10.2013 at New Delhi under the Chairmanship of Shri. T. N. Rahate, President, FNPO.

NFPE, P3 CHQ & R3 CHQ FILED RTP CASE IN CAT PRINCIPAL BENCH DELHI ON 08.10.2013
NFPE, P3 CHQ & R3 CHQ has today jointly filed a case in the CAT Principal Bench Delhi for counting of RTP Service as regular service for all promotions and pensionary benefits. Case registration No. 3647/2013 dated 08.10.2013. Com. S. K. Vyas Ji, Veteran Leader of the Confederation is our Advocate. Hereafter there is no need for filing separate cases by employees.
Let us hope for the best.

Subject:- Productivity Linked Bonus for the Accounting year 2012-2013.
Sir/Madam,
                        I am directed to convey the approval of the President of India for payment of Productivity Linked Bonus for the accounting year 2012-2013 equivalent of emoluments of 60 (Sixty) days to the employees of Department of Posts in Group `D`,Group `C` and non Gazetted Group `B`. Ex-gratia payment of Bonus to Gramin Dak Sevaks who are regularly appointed after observing all appointment formalities and adhoc payment of Bonus to Casual labourers who have been conferred Temporary Status are also to be paid equivalent to allowance/wages respectively for 60 (sixty) Days for the same period.
1.1              The calculation for the purpose of payment of Bonus under each category will be done as indicated below.
2.                              REGULAR EMPLOYEES:
2.1       Bonus will be calculated on the basis of the following formula:-
                                                Average emoluments X Number of days of Bonus
30.4(Average no. of days in a month)
2.2 The term “Emoluments” for regular Employees include basic Pay in the pay Band plus Grade Pay, Dearness Pay, Personal Pay, Special Pay (Allowances), S.B.Allowance, Deputation (Duty ) Allowance, Dearness Allowance and Training Allowance given to Faculty Members in Training Institutes. In case of drawl of salary  exceeding Rs.3500/- (Rs. Three Thousand Five hundred only) in any month during the accounting year 2012-13 the Emoluments shall be restricted to Rs.3500/- (Rs. Three Thousand Five hundred only) per month only.
2.3 “ Average Emoluments” for regular Employees is arrived at by dividing by twelve ,the total salary drawn during the year 2012-13 for the period from 1.4.2012 to 31.3.2013, by restricting each month’s salary to Rs.3500/- (Rs. Three Thousand Five hundred only) per month. However, for the periods  of EOL and dies-non in a given month ,proportionate deduction is required to be made from the ceiling limit of  Rs.3500/- (Rs. Three Thousand Five hundred only).
2.4 In case of those regular employees who were under suspension, or on whom dies-non was imposed ,or both, during the accounting year, the clarificatory order issued vide Paras 1 & 3 respectively of this office order No. 26-8/80-PAP (Pt-I) dated 11.6.81 and No. 26-4/87-PAP (Pt.II) dated 8.2.88 will apply.
2.5              Those employees who resigned, retired, left service or proceeded on deputation within the Department of Posts or those who have proceeded on deputation outside the Department of Posts on or after 1.4.2012 will also be entitled to Bonus. In case of all such employees, the Bonus admissible will be as per provisions of Para 2.1 to 2.3 above.
3.                  GRAMIN DAK SEVAKS (GDS)
3.1  In respect of Gramin Dak Sevaks who were on duty through out the year during 2012-2013, Average monthly Time Related Continuity Allowance will be calculated taking into account the Time Related Continuity Allowance (TRCA) plus corresponding Dearness Allowance drawn by them for the period from 1.4.2012 to 31.3.2013 divided by 12 (Twelve). However, where the Time Related Continuity Allowance exceeds Rs 3500/- (Rs.Three Thousand Five hundred only) in any month during this period., the allowances will be restricted to  Rs 3500/- (Rs.Three Thousand Five hundred only) per month. Ex-gratia payment of Bonus may be calculated by applying the Bonus formula as mentioned below:-
                                          Average TRCA  X  Number of days of Bonus
                                                     30.4 (Average no. of days in a month)
3.2      The allowances drawn by a substitute will not be counted towards Bonus calculation for either the substitute or the incumbent Gramin  Dak Sevaks. In respect of those Gramin Dak Sevaks who were appointed in short term vacancies in Postman/Group `D` Cadre, the clarificatory orders issued vide Directorate letter No. 26-6/89-PAP dated 6.2.1990 and No.  26-7/90-PAP dated 4.7.91 will apply.
3.3      If a Gramin Dak Sevak has been on duty for a part of the year by way of a fresh appointment, or for having been put off duty, or for having left service, he will be paid proportionate ex-gratia Bonus calculated by applying the procedure prescribed in Para 3.1
3.4        Those Gramin Dak Sevaks who have resigned, discharged or left service on or after 1.4.2012 will also be entitled to proportionate ex-gratia Bonus. In case of all such Gramin Dak Sevaks, the Ex-gratia Bonus admissible will be as per provisions of Para 3.1 above.
3.5      In case of those Gramin Dak Sevaks who were under put off duty or on whom dies non was imposed, or both during the accounting year ,the clarificatory orders issued vide Para 1 & 3 respectively of this office order No. 26-8/80-PAP (Pt I) dated 11.6.81 and No. 26-4/87-PAP (Pt II) will apply.
4.                  FULL TIME CASUAL LABOURERS INCLUDING TEMPORARY STATUS CASUAL LABOURERS)
            Full Time Casual Labourers (including Temporary Status Casual Labourers ) who worked for 8 hours a day, for at least 240 days in a year for three consecutive years or more (206 days in each year for three years or more in case of offices observing 5 days a week) as on 31.3.2013 will be paid ad-hoc Bonus on notional monthly wages of Rs.1200/- (Rupees Twelve Hundred only)
 
                                          The maximum ad-hoc Bonus will be calculated as below:-
                                    (Notional monthly wages of Rs.1200) X (Number of days of Bonus)
                                                            30.4 (average no. of days in a month)
                        Accordingly , the rate of Bonus per day will work out as indicated below:_
                                                            Maximum ad-hoc Bonus for the year
                                                                                       365
            The above rate of Bonus per day may be applied to the number of days for which the services of such casual labourers had been utilized during the period from 1.4.2012 to 31.3.2013. In case where the actual wages in any month fall below during the period 1.4.2012 to 31.3.2013 the actual monthly wages drawn should be taken into account to arrive at the actual ad-hoc Bonus due in such cases.
5.         The amount of Bonus /Ex gratia payment /Adhoc Bonus  payable under this order will be rounded to the nearest rupee. The payment of Productivity Linked Bonus as well as the ex-gratia payment and ad-hoc payment will be chargeable to the Head `Salaries` under the relevant Sub –Head of account to which the pay and allowances of the staff are debited. The payment will be met from the sanctioned grant for the year 2013-2014.
6.         After payment, the total expenditure incurred and the number of employees paid  may be ascertained from all units by Circles  and consolidated figures be intimated to the Budget Section of the Department of Posts. The Budget Section will furnish consolidated information to PAP  Section about the total amount of Bonus paid and the total number of employees (category-wise) to whom it was distributed for the Department as a whole.
